MENAKER & HERRMANN LLP has an extensive practice in real estate litigation and transactions. Our clients include commercial real estate managers, developers, landlords, tenants and residential users of real estate. We have extensive experience negotiating leases for commercial, industrial, office, retail and shopping center space on behalf of both landlords and tenants. We have represented financial institutions and borrowers in lendings secured by commercial and residential property, and we also represent individuals in the purchase of all types of personal residences (single family homes, townhouses, condominiums and cooperative apartments).

The Firm also represents a number of cooperative apartment buildings and condominium associations in New York City on a range of issues. We have a strong track record of finding ways to avoid litigation and resolve issues with landlords or tenants before they result in litigation. While we are prepared to litigate when necessary, we believe that our clients are better served when we chart a course which resolves disputes without recourse to litigation.

When real estate litigation is necessary, the Firm has the expertise to handle it. Having represented major office and commercial landlords in the landlord and tenant courts of New York on a regular basis, we serve clients in matters concerning the most complex and difficult landlord and tenant issues. We have successfully litigated tenant class actions based on common lease provisions, represented lenders in mortgage foreclosures, dealt with unusual asbestos, EMF and other "sick building" issues and defended landlords in disputes involving contested lease interpretations. Notable successes for our clients include a multi-million dollar action on behalf of a tenant bank seeking to hold its landlord accountable for costs of asbestos abatement, as well as a significant case regarding continuing jurisdiction over tenants once they have surrendered possession of the disputed premises.
